1. Terms of Use of the Website
By accessing www.arcax.ai, you agree to these terms. The site presents information about the Arcax software product published by Talentys Group. Content is provided for informational purposes only without warranty of accuracy or completeness.
You may not scrape, reproduce, or redistribute content from this site without prior written permission from Talentys.
2. Software Licence
The Arcax software is made available under the terms agreed in your Talentys subscription or enterprise agreement. Evaluation access may be provided under a time-limited evaluation licence.
Unless otherwise agreed in writing:
- Arcax source code is proprietary. You may not copy, modify, sublicence, or distribute it.
- Arcax SDKs and client libraries (sdk-java, sdk-node) are available under the MIT Licence as indicated in those packages.
- You may not use Arcax to build a competing product or service.
3. General Terms of Sale (CGV)
3.1 Scope
These General Terms of Sale apply to all commercial transactions between Talentys Group and its enterprise customers for the Arcax platform.
3.2 Orders and Activation
All orders require a signed Statement of Work or accepted commercial proposal. Licences are activated upon receipt of payment or as agreed in the contract.
3.3 Pricing
Prices are quoted in EUR excluding applicable taxes. Annual licences are invoiced in advance. Professional service fees are billed monthly in arrears unless otherwise agreed.
3.4 Payment Terms
Invoices are payable within 30 days of issue. Late payments incur interest at 3× the ECB base rate per annum plus a flat recovery fee of €40.
3.5 Cancellation
Annual subscriptions are non-refundable after the 14-day evaluation period. Cancellation at renewal requires 60 days written notice before the anniversary date.
3.6 SLA
Standard support SLA: P1 critical — response within 4 business hours; P2 high — 1 business day. Enterprise SLA with 99.9% uptime guarantee available on request.
3.7 Data and Privacy
Arcax is deployed entirely on your infrastructure. Talentys has no access to your data unless you explicitly request remote assistance with full audit trail.
4. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TALENTYS GROUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR BUSINESS, ARISING OUT OF OR RELATING TO THE USE OR INABILITY TO USE ARCAX OR THIS WEBSITE.
Talentys's total cumulative liability under any contract shall not exceed the fees paid by the customer in the 12 months preceding the claim.
5. Intellectual Property
All trademarks, brand names, logos, documentation, and software related to Arcax are the exclusive property of Talentys Group. The "AX" mark and "Unified Agentic Mediation" terminology are proprietary to Talentys.
Any feedback, suggestions, or improvements you provide may be used by Talentys without restriction and without compensation.
6. Governing Law and Jurisdiction
These terms are governed by French law. Any dispute shall be subject to the exclusive jurisdiction of the Commercial Court of Paris, unless mandatory consumer protection law in your country of residence provides otherwise.
For Moroccan enterprise customers, disputes may alternatively be resolved before the Commercial Court of Casablanca.

Talentys reserves the right to update these terms at any time. Material changes will be communicated by email to active customers and/or announced on this page with at least 30 days notice. Continued use of Arcax after the effective date constitutes acceptance.
